What is a LMIA?

A Labour Market Impact Assessment is a document that an employer in Canada may need to get before hiring a foreign worker.

If the employer in Canada need to prove that the vacant position cannot be filled by a Canadian worker or a permanent resident, a positive LMIA will be issued. The positive LMIA will be issued by Employment and Social Development Canada(ESDC).

When applying for a work visa, in addition to the necessary application documents, the employer needs to provide:

1. Job Offer

2. Work contract

3. A positive LMIA

4. the LMIA number

Exemption from Labor Market Impact Assessment

There are some situations that the applicants can apply for a work permit without LMIA.

For example: Spouse open work permit, International Experience Canada (applicable to applications for specific nationalities), post-graduation work permit, work permit supported by provincial or territorial department, refugee work permit, etc.

Eligibility for employers to apply for LMIA:

1. Legal companies registered in Canada and companies providing commercial goods and services

2. Have made recruitment efforts and can prove that no Canadian citizen or permanent resident is available to do the job.

3. Have not violated of IRPR and IRPA

4. Wages are competitive

5. The employer shall provide the company's tax forms, financial statements, payroll etc. to prove the operation and need for the position.

6. The position provided is required by the enterprise and the employer is capable of providing the position and performing the responsibilities in the labor contract

7. If it is an individual employer, provide personal tax return records.

Advantages of Applying for LMIA

1. If the position provided by the employer is NOC 00 and the applicant meets other eligibility of Express Entry, 200 points can be added to the Express Entry.

2. If the position provided by the employer is NOC 0, A, B, and the applicant meets other eligibility of Express Entry, 50 points can be added to the Express Entry

3. The maximum length of LMIA work permit is two years. After one year of work, those who meet the conditions can apply for permanent resident through Express Entry or other possible streams.

4. From August 20, 2020 to February 28^th 2023, eligible applicants who hold a visitor visa in Canada can apply for employer-specific work permit inside Canada.
